Trustee now wants 2008 tax refund

Yep. Although there had been no previous mention of it, she contacted my lawyer and requested any refund we may receive this year from our 2008 taxes. Although I did suspect this may happen, but thought we may have heard of the request previously or at our 341 meeting.

Item’s to prepare our taxes hasn’t even arrived yet. Oh well.

Countrywide granted relief of stay to start foreclosure

Today on PACER I see our mortgage lender Countrywide was granted a relief of stay from the court. Even though we are surrendering our house in the bankruptcy, they still have to go through the foreclosure process to get this house back. This seems like a waste to me, but it’s the law.

On the web, I have seen many people staying in their homes for several months. I’ve met one guy, who is also here in Florida going through bankruptcy also. Countrywide is also his lender, it has now been 13 months and he is still in the house.

It appears in our county, once countrywide gets the approval for sale from the court the “sale date” is 90 days from the ruling. That gives us a few months hopefully. We have decided to re-locate back to the midwest, even though we have been in Florida for almost 18 years. This will be a big change.

One thing that worries me, is our lawyer said we should be out in about 30 days from now. I’m gonna just lay low, and see what happens at this point. And keep my eye on the county clerks website for our name to come up.

Documents sent to trustee and business asset information

The documentation was sent off to the trustee as she had requested. It was about 2000 pages! I also got information from her concerning the sale of some business assets. Since the corporation is not filing bankruptcy, it is a personal bankruptcy, I as the owner of the business need to deal with the assets as I see fit.

Any assets sold, however need to be “fair market value” as if the business must file bankruptcy in the future any monies will need to be accounted for and turned over to the court. Any normal expenses are allowed to be spent.

The fair market value comes into play like I had mentioned in earlier posts. This prevents people from selling assets cheap to friends, family, etc. This would be preferential tratment, and/or improper transfer of assets.

Hopefully the sale will go through, less stuff to worry about.

Lots of documents for the trustee

Boy… She wants a lot of documentation. 14 months of bank statements, ALL checks written from all business and personal accounts, documentation where money was spent on a business loan from last year, two years tax returns, and more.

This is going to be a PILE of documents. There are over 400 checks alone, plus most of my business checking account statements are 15-20 pages each! (there are multiple business accounts, too)

I suppose this is her job. She is looking for things like illegal transfer of assets, preferential treatment, etc. Which is not a big deal for us… we didn’t do anything like this. But I suppose there are poeple who try to cheat the system, and trustee’s like her will find them! She needs all this by Novemver 14th. So at least I have a little time to get copies of the checks from the bank.

A few more accounts are showing included in bankruptcy. My credit score has now dropped to 523. My wifes is still up at 580 at this point.
