Scheduled sale of bankruptcy estate items

Today we got a notification the trustee has scheduled the sale of our items surrendered in our bankruptcy. It is tentatively scheduled for March 23, but she may put it off until april 6 for some reason. I’ll be curious to see what happens. One thing I did find out is that it is a all or nothing sale. In otherwords different people won’t bid per item, one person has to buy everything.

The cars we surrendered will be sold individually and seperate from everything else.

Bankruptcy trustee throws a wrench in stipulation

I can NOT believe this! After having agreed on everything and everyone agreed on the outcome, we get the actual written stipulation agreement. NOW, she claims we need to give her our 2007 tax refund which was received in 2008, as well as our 2008 refund, we will get later this year. At no point at any time have the 2007 refund been mentioned! She even asked us at our 341 in November if we had gotten the refund… which we had and already spent on day to day expenses prior to filing our case!

I urgently called my lawyer, and let him know we have a problem. He said he’s not suprised she tried to sneak something in at the end. He assumes he will now have to attend the hearing the end of the week, that had been scheduled from one of her previous disptes. I can’t believe this! Ugh!

He will contact her, and try to determine if this is incorrect, or if she really is trying to claim the refund. I hope I hear something quick. I’m gonna have a frickin’ stroke.

Trustee issues worked out stipulation agreement on the way

Good news, trustee removed the security deposit. We don’t know exactly how she calculated it, but states my wifes exemptions are just under her allowed amount. But wants her to pay $100 toward her clothes! Unbeliveable! So just to get it moving, we agreed. My lawyer even emailed, he can’t believe we are having isues over my wifes jeans & t-shirts!

Anyway, we should have the stipulation agreement on Tuesday, and will be able to move along. From one of her earlier disputes, my bankruptcy lawyer is supposed to attend a hearing on Friday. Now, he shouldn’t have to. YEA! :)

Bankruptcy Trustee has problem with new schedules

Today I got a call from my lawyer about our newly revised schedules. The trustee hasn’t filed an actual dispute this time through the court, but states that an item on the original petition is not on the new schedule, also she claims a security deposit that was from my business should be included. However she dropped all other business related items. So my attorney is going to show here it WAS a business deposit, not personal.

The item she claims is not on the schedule are books, valued at $20. We had to send her a dividend check, that she applied part of that money to. We still had about $400 of unused exemptions, so it should really be a non-issue. Hopefully the security deposit, and book issue can be resolved quickly, and get things moving along.

3rd personal property exemption schedule submitted

Today after reviewing the updated schedules, they were submitted one more time! This is our 3rd schedule “C”, and second updated schedule “B”. We drilled the numbers over and over. Making sure there is no problems that the trustee could disagree with.

Now… we have also submitted a spreadsheet to the trustee with exactly what items from our petition and appraisal we included in the updated schedule that we are claiming as exempt property, and what items will be surrendered.

Lets hope she doesn’t have any issues, or disputes these schedules!
