Got a call from my bankruptcy lawyers office today. The trustee is inquiring about our taxes. (Remember we have to surrender any refund we may get) At this point my accountant hasn’t got them finished. So we will have to wait. This should be the last thing… so we can get this finished once and for all.

Friday, April 24th, 2009Well… We got a call from our lawyers office to contact the private stock issuer that my wife has to surrender.
After calling, the trustee instructed him to request the original certificate, and sell the shares so the estate can get it’s money.
My waife was able to keep a couple shares as her exemption in the bankruptcy estate. As you recall, she was very sentimental as this was left to her by a great aunt… and had no idea it had much value.
We tried to keep it… but with out PIA trustee, it was not possible. And with virtually no money ourselves there was no way to keep it.
The wife is not a happy camper today… this makes my life rough. I wish I hadn’t put her through this.
Trustee issues worked out stipulation agreement on the way
Monday, February 16th, 2009Good news, trustee removed the security deposit. We don’t know exactly how she calculated it, but states my wifes exemptions are just under her allowed amount. But wants her to pay $100 toward her clothes! Unbeliveable! So just to get it moving, we agreed. My lawyer even emailed, he can’t believe we are having isues over my wifes jeans & t-shirts!
Anyway, we should have the stipulation agreement on Tuesday, and will be able to move along. From one of her earlier disputes, my bankruptcy lawyer is supposed to attend a hearing on Friday. Now, he shouldn’t have to. YEA!
Bankruptcy Trustee has problem with new schedules
Thursday, February 12th, 2009Today I got a call from my lawyer about our newly revised schedules. The trustee hasn’t filed an actual dispute this time through the court, but states that an item on the original petition is not on the new schedule, also she claims a security deposit that was from my business should be included. However she dropped all other business related items. So my attorney is going to show here it WAS a business deposit, not personal.
The item she claims is not on the schedule are books, valued at $20. We had to send her a dividend check, that she applied part of that money to. We still had about $400 of unused exemptions, so it should really be a non-issue. Hopefully the security deposit, and book issue can be resolved quickly, and get things moving along.
Updated exemptions to attorney for submission
Friday, January 30th, 2009Last night and today I went over the overage worksheet supplied by the trustee and the appraisal we had previously received. We went over all the personal property from the appraisal, as well as the overage worksheet. I created a new spreadsheet for my lawyer with a general sheet of exemptions that matched the trustees values, and a second one with all the persoanl property.
He combined them into one for his use to use on the new schedule he has to file, and e-mailed it over. We only had to make a minor correction. He will now use this to fill out the updated schedule. Oh YEA! I forgot to mention, the trustee had mentioned she is not interested in the business assets, as they are not part of the persoanl property of the bankruptcy. EXCEPT, there is a $4200 deposit she had included on the worksheet, that was actually a business asset/expense. So hopefully she will drop that item and all will go smoothly.
If she claims we need to include that, I’ll be screwed! In that case, we will surrender virtually ALL our persoanal property, except for clothes and a couple household items. Lets hope it goes our way. I can’t imaging she will dispute a fourth time. But we’ll keep the blog updated to the progress.
