Completed Pre discharge education course

We completed the post filing (sometimes called pre discharge) debtor education course tonight. And just in the nick of time. You are required to have this completed 45 days after your 341 meetings. Depending on how you count today is 44 or 45. PACER shows 45 days. I hope this isn’t a problem. My lawyer will submit it in the AM.

Trustees THIRD objection to exemptions in Chapter 7 Case

Yep… Just as I expected our trustee objected to our third updated exemptions. My lawyer states he’s tired of messing with her, and will file a motion with the judge to get things moving. Unbelievable. She also referenced my portion of the exemptions, and referenced the appraisal that was done almost a month ago.

We will have to see what happens now.

Today we changed our exptions AGAIN now for the 3rd time due to the trustees objections. One thing I forgot to mention yesterday was we had received a $1000 dividend in December from the stock, which has caused some problems. Since it (the stock) was property of the bankruptcy estate, the trustee requires we repay the dividend to her. Keep in mind I’m not working… we used it for everyday expenses… now we need to come up with $1000 for her. What a pain.

My attorney said if the trustee objects again, he is going to go to court in front of the judge as she is causing undo grief. We are only trying to claim what we are entitled to by the law, nothing more. We have already agreed to surrender virtually everything. We’ll just have to see what happens.

New year and same credit scores

It’s 2009! Neither one of us has had any activity in our credit scores in about a month. We are stagnant at 542 for me, and 551 for my wife. This is about a 136 points lower than a couple months before the bankruptcy, and my wifes is 196 lower than pre-bankruptcy.

Our 60 days toward our bankruptcy discharge should occur later this month. Hopefully score will rebound after the bankruptcy debt discharge.

Bankruptcy trustee causes even more grief

I got an e-mail from my bankruptcy lawyer today. It is from our trustee concerning the stock previously mentioned in other earlier posts. It was dated December 23, but my attorney was out of town…. (as were we) so at least it didn’t screw up our christmas.

Basically it said she is taking all of the stock as the debtors (Us) obviously do not have available funds to repurchase the stock.

Well, as I mentioned before we needed to amend our schedule C anyway due to her previous objection. We figure my wife will be able to claim a portion of the stock for her exemptions, and I will get some exemptions as well. We still have not gotten a copy of the appraisal they did, so I’m not sure what I can claim. And time is running out. My lawyer has to respond to the previous objection by January 6th.
