Day 60 after 341 meeting and no discharge in site

Today is day 60 after our 341 meeting of creditors. For the majority of chapter 7 personal bankruptcy cases… day 60 is the magic day. The day of discharge when you are no longer liable for your debts. Many districts around the country discharge almost automatically on day 60, and the case is closed shortly thereafter.

In our case, since we are now considered an asset case closing will not take case until the assets are sold, and the trustee distributes all the funds to creditors. However, our bankrutcy discharge can take place at any time.

We are hoping this will happen after the objections are settled and items to be surrendered are agreed upon. We’ll keep you up to date!

Finally, after a month! I logged into my PACER account last night, and saw an order for the appraiser to be paid, which had a copy of the appraisal included. I was actually suprised. It was almost identical in dollars to what we had included in our chapter 7 bankruptcy petition.

If we didn’t have the problem with the private stock we didn’t know about, and if we wanted to challenge the trustee to the car values… we’d be right on target.

It looks like I will need to surrender about $1500 worth of stuff (Depending on how a hearing goes with the trustee about my wifes stock value). Based on what I’ve seen elsewhere on the web, we will pick and choose what personal property we want to surrender and what we will keep.

Hopefully the hearing the trustee requested will get scheduled soon, and we will be able to get on with this whole thing.

No credit history changes or credit score changes

No changes or updates at all in our credit scores for the past week. Mine have not changed since the end of November.

Trustee now wants 2008 tax refund

Yep. Although there had been no previous mention of it, she contacted my lawyer and requested any refund we may receive this year from our 2008 taxes. Although I did suspect this may happen, but thought we may have heard of the request previously or at our 341 meeting.

Item’s to prepare our taxes hasn’t even arrived yet. Oh well.

Increased credit score for wife

Today my wifes credit score jumped from a 551 up to a 580. This was do to accounts on her credit score being changed to IIB (Included in Bankruptcy).

No changes since November 22 for me.

We use several items from equifax to monitor our credit reports and credit scores. We use Equifax Credit Watch Gold 3-in-1, Equifax Score Watch, and Equifax Score Power Whis is pretty cool as you get e-mail alerts to notify you of any changes to your credit reports, or credit scores.
