Yep. Although there had been no previous mention of it, she contacted my lawyer and requested any refund we may receive this year from our 2008 taxes. Although I did suspect this may happen, but thought we may have heard of the request previously or at our 341 meeting.
Item’s to prepare our taxes hasn’t even arrived yet. Oh well.

Steve, it sounds to me like you are not getting good legal advice.
I believe you may have filed too quickly. I think you might seriously consider dropping the case for now, gather your assets such as they are, and live off them for a few months, possibly moving to your final destination in the meantime,definitely find a better lawyer.
It’s not my lawyer, or advice. It’s the trustee. I’ve gotten several e-mails, and talked to a number of people from our area. Our trustee has a national reputation for being tough. I reviewed over 15 of her cases from the last year. EVERY ONE except one was changed from a no asset filing to an asset case. EVERY ONE had a personal property appraisal ordered by her. This is definately not normal in most districts. At this point we’re too far in, and with the business complications, not worth trying to drop it.
